Section 43 of the Legal Practitioners Act statutorily establishes a Disciplinary Committee of the Council which shall consist of five members appointed by the Council from among its member of the society. The function of the Committee is to hear complaints from any person against an attorney registered in the Law Society of Botswana. The committee is to investigate a complaint and if they consider the complaint is one of professional misconduct then it may recommend to the Council that the attorney be:
(a) Warn or reprimand the practitioner; or
(b) Impose a fine not exceeding P10 000 on the legal practitioner.
Furthermore, if the committee considered the misconduct to be of serious nature that it warrants suspension or removal from the roll then it may recommend to the Council to:
(a) To suspension him from practising for a specified period; or
(b) To have his mane removed from the roll.
A copy of this recommendation by the Disciplinary Committee shall be served to the Attorney-General.
