1. In terms of Section 32 (2) every Practicing Certificate shall expire on the 31st December of each year.
2. Every Legal Practitioner (Advocate, Attorney, Conveyancer and Notary Public) is required in terms of Section 29 (1) of the Legal Practitioners Act (LPA) to hold a Practicing Certificate which is valid for that year in order to be entitled to practice.
3. The Annual General Meeting (AGM) has Resolved that names of Legal Practitioners who do not hold Practicing Certificates in each year and are therefore not entitled to practice, be published immediately after the Opening of the Legal Year. The AGM Resolution relates to publication and does not seek to extend or give a waiver to the provision of the LPA that practicing certificates expire on the 31st December of each year.
4. In terms of Section 56 (a) of the same Act, the membership of the Law Society of Botswana shall comprise amongst others of a person who is admitted as an Attorney or Advocate and, except where exempt, holds a Practicing Certificate.
5. As of 6th August 2024, the following legal practitioners (attorneys and advocates) do not hold current practicing certificates and are therefore not entitled to practice. They are further not members of the Law Society of Botswana by virtue of not holding a valid Practicing Certificate.
6. In view of the status of the attorneys as set out above, members of the public who engage or continue to deal with them are doing so at their own risk and will have no recourse or redress from the Law Society.
7. Members of the public are further advised that the 2024 publication of non-compliant attorneys was delayed due to challenges some members faced while attempting to make payment for their practicing certificates at the High Court. These challenges were brought about by the inefficiencies of the Government Accounting and Budget System and of no fault of the membership.
